Terms of Service
Please read these Terms carefully before placing an order. They set out your rights and our obligations under UK consumer law.
1. About Us
These Terms of Service govern all purchases made through the NovaTech Systems website. Please read them carefully before placing an order.
NovaTech Systems is a trading name of Andrei Cosma, a sole trader registered in the United Kingdom.
Registered Address: 184 Dalriada Crescent, Motherwell ML1 3XS, Scotland, UK
Email: contact@coscomtech.co.uk
By placing an order with us, you agree to be bound by these Terms. These Terms do not affect your statutory rights as a consumer under UK law.
2. Placing an Order
How a Contract is Formed
When you place an order through our website, you are making an offer to purchase the products selected at the prices shown. Your order constitutes an offer and no contract exists until we accept it.
We will acknowledge receipt of your order by email ("Order Received" notification). This acknowledgement is not an acceptance of your order. A binding contract is formed only when we send you an "Order Confirmed" or dispatch notification email.
We reserve the right to decline any order at our discretion, for example if products are out of stock, if we identify a pricing error, or if we are unable to verify payment. If we decline your order, we will notify you promptly and arrange a full refund of any payment taken.
Order Accuracy
You are responsible for ensuring the accuracy of your order details, including delivery address, product specifications, and any customisation options selected. Please review your order carefully before confirming payment.
3. Pricing and Payment
Prices
All prices are displayed in pounds sterling (GBP). Prices are as shown on the product listing at the time you place your order. We reserve the right to change prices at any time prior to your order being accepted.
If a pricing error is discovered after your order has been placed, we will notify you as soon as reasonably practicable. You will have the option to confirm the order at the correct price or cancel it for a full refund.
Payment
Payment is required in full at the time of ordering. We accept payment via the methods displayed at checkout. All payment transactions are processed securely by Stripe. We do not store your payment card details.
Custom PC Builds
For bespoke, made-to-order custom PC builds, we may require full payment in advance. Please refer to the product listing and order confirmation for specific terms applicable to your build.
4. Delivery
Delivery Timescales
Estimated delivery timescales are provided at the time of ordering and on your order confirmation. These are estimates only and are not guaranteed delivery dates. Delivery timescales for standard components are typically 1–5 business days. Custom-built PC systems may require additional build time, which will be stated at the point of purchase.
Delivery Methods and Charges
Delivery charges, where applicable, are displayed clearly at checkout before you confirm your order. Delivery is made to the address you provide. It is your responsibility to ensure the delivery address is correct and that someone is available to receive the goods.
Risk and Ownership
Risk in the goods passes to you on delivery. Ownership of the goods passes to you on receipt of full payment.
Delivery Failure
If delivery is attempted and fails because no one is available to accept the parcel, the courier will leave instructions for re-delivery or collection. We are not liable for delays or additional costs arising from failed delivery where the address provided is incorrect or access is unavailable.
5. Your Right to Cancel (Consumer Contracts Regulations 2013)
If you are a consumer purchasing goods for personal use, you have the right to cancel your order and receive a full refund under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Cancellation Period
You have 14 calendar days from the day you receive your goods to cancel your order without giving any reason.
How to Cancel
To cancel, please notify us in writing at contact@coscomtech.co.uk before the 14-day period expires. You should clearly state your name, order number, and which items you wish to cancel.
Returning the Goods
Following cancellation, you must return the goods to us promptly and in any event within 14 calendar days. You are responsible for the cost of return postage unless the goods are faulty or not as described.
Refunds
We will process your refund within 14 calendar days of receiving the returned goods, or evidence that they have been dispatched, whichever is earlier. Refunds are issued to the original payment method.
Exceptions
The right to cancel does not apply to:
- Bespoke or custom-made goods (including custom-built PC systems assembled to your specific configuration), where the build process has commenced.
- Sealed software, sealed media, or sealed hygiene products that you have opened after delivery.
We will clearly indicate on any product listing where cancellation rights are limited.
6. Returns and Refunds
Faulty or Damaged Goods
If you receive goods that are faulty, damaged in transit, or not as described, please contact us within 30 days of receipt at contact@coscomtech.co.uk. You are entitled under the Consumer Rights Act 2015 to:
- A full refund within 30 days of delivery if the goods are faulty or not as described.
- A repair or replacement at any time within the first 6 months if a fault appears (unless we can show the fault was not present at delivery).
- After 6 months, you may still have a remedy where you can demonstrate the fault was present at delivery.
Change of Mind Returns
Outside of the statutory 14-day cancellation period, we do not accept change-of-mind returns unless the goods are faulty. If you are unsure whether a product is right for you, please contact us before purchasing.
Condition of Returned Goods
All returned goods must be in original condition and, where applicable, in original packaging. We reserve the right to deduct from your refund an amount reflecting any diminishment in value caused by unnecessary handling beyond what is needed to inspect the goods.
7. Warranties and Product Quality
Consumer Rights Act 2015
All products sold by NovaTech Systems must be of satisfactory quality, fit for purpose, and as described. Your statutory rights under the Consumer Rights Act 2015 are not affected by anything in these Terms.
Manufacturer Warranty
Where products carry a manufacturer's warranty, this is provided by the manufacturer and is in addition to your statutory rights. Details of any applicable manufacturer warranty will be provided with the product or in the product listing.
Custom Builds
Custom-built PC systems assembled by NovaTech Systems are covered by a build quality guarantee. If a fault arises from our assembly or configuration within 12 months, we will rectify it at no additional charge. Component faults are covered by the relevant manufacturer's warranty.
8. Limitation of Liability
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded by law, including your statutory rights as a consumer under the Consumer Rights Act 2015
Subject to the above, we will not be liable for:
- Indirect or consequential losses, including loss of data or loss of profits
- Losses that were not foreseeable to both parties at the time the contract was made
- Losses arising from events outside our reasonable control (force majeure)
Our total liability in connection with any order shall not exceed the price paid for the goods in question.
9. Intellectual Property
All content on the NovaTech Systems website — including text, images, graphics, logos, product descriptions, and software — is owned by or licensed to us and is protected by UK and international intellectual property law. You may not reproduce, copy, distribute, or exploit any content from this website without our written permission, except for your own personal, non-commercial use.
10. Governing Law and Disputes
These Terms of Service and any contract formed under them are governed by the law of Scotland and subject to the exclusive jurisdiction of the Scottish courts, except that:
- If you are a consumer resident in England or Wales, you may bring proceedings in the courts of England and Wales.
- If you are a consumer resident in Northern Ireland, you may bring proceedings in the courts of Northern Ireland.
Online Dispute Resolution
The European Commission provides an Online Dispute Resolution (ODR) platform for resolving disputes between consumers and traders. We are not obliged to participate in alternative dispute resolution but will endeavour to resolve complaints directly and promptly. Our email address for complaints is contact@coscomtech.co.uk.
If you have a complaint about our service, please contact us first and we will aim to resolve the matter within 5 business days.
11. Changes to These Terms
We reserve the right to update these Terms of Service at any time. The version in effect at the time you place your order will govern that contract. We will not apply updated Terms retrospectively to orders already placed.
The current version of these Terms is always available on this page. The "Last Updated" date at the top indicates when the most recent changes were made.
